Chiropractors are notorious for “keeping their patients coming back.” Many advise everyone to have their spine checked for “subluxations” and “adjusted” throughout life. In 1992, Florida Trend magazine published a cover story on “why chiropractors get blamed for fueling the cost of workers’ compensation.” The author concluded that, “Workers’ compensation is fraught with abuse, but no other players in the system rile business more than the chiropractors.” A spokesman for the American Insurance Association even said that, “Sometimes I think of workers’ comp as the chiropractic full-employment act.” Some health-insurance companies called for limits on chiropractic treatment, and some wanted chiropractors out of the WC system altogether. The main complaints were about exaggerated diagnoses, overtreatment, and aggressive marketing aimed at patient retention from cradle to grave. The author also noted:

Less scrupulous attorneys turn to chiropractors, hoping they will give injured workers the highest impairment rating and extend treatment for as long as possible. The chiropractors who play the game are then rewarded with a steady stream of clients provided by their unspoken lawyer/partners.

The payback for a lawyer comes in the medical expenses: The larger the expenses, the more the lawyer can expect, with legal fees paid by the insurer. . . . If a carrier disputes a claim . . . the lawyer can rack up hefty costs for time-consuming depositions and pre-trial appearances. Meanwhile, the chiropractor continues to provide treatment [1].

Two studies have focused attention on the problem in California. The first one, published by the Workers Compensation Research Institute of Cambridge, Massachusetts, analyzed 28,539 workers’ compensation cases involving back strains and sprains in California and four other states and concluded:

  • Chiropractic care could achieve the same outcome at lower costs if the number of visits were limited (see Figure A).
  • Chiropractor-directed physical medicine care costs 30% more than physician-directed care and achieved the same outcomes as measured by duration of temporary disability.
  • The higher number of visits that chiropractors use per case is the major driver behind the higher physical medicine payments.
  • In Florida, chiropractic care achieved the same outcome at lower cost than physician-directed physical medicine care in Florida where reimbursement rules place strict limits on the number of chiropractic visits per case that will be reimbursed by workers’ compensation payors. The fact that treatment and billing practices by Florida chiropractors result in lower medical costs while achieving a similar duration of disability as physician-directed care may provide lessons that other states can draw from.
  • Physical medicine services are most often used for back injuries, representing 41% of all injuries that receive such services. This is not surprising

Disability Insurance Vs. Life Insurance – Which Is Better?

I think that most people would agree that the we live in a state of insurance overload in this country. You need insurance to drive a car, you need it to buy a house (at least you do if you want to get a mortgage from a bank!), you need health insurance to cover medical costs… it seems like everywhere you turn there’s more insurance to buy!

It can become overwhelming for most people, but there’s one area of insurance that you don’t want to overlook and it’s an area that most people do overlook. I’m talking about disability and life insurance.

First of all, what are these two things?

Life insurance is simply insurance that pays your family a set amount of money in the case of your early death. If you get hit by a train or fall out of an airplane or laugh too hard during a funny movie and choke on a pretzel and suddenly die, life insurance makes sure that your family is provided for financially and that their standard of living does not decrease just because you’re not around to pay the bills anymore.

Disability insurance is very similar. The only real difference is that it isn’t focused on your death but merely on your disability. This is particularly important if you have a manual labor type job. So if you break your leg and can’t work for six months, that loss of income won’t affect you because your policy will pay out instead.  

Your employer may already have disability insurance as part of your pay package but chances are they don’t. You’re going to need to find out for yourself whether they offer it or not and if they don’t you’ll need to go out and purchase it on your own.

In a perfect world you should have both of these types of insurance to cover your family in case you die or in case you get hurt and can’t work anymore. Of course, we don’t always live in a perfect world and many people choose one or the other… so which one is best?

That’s a question I can’t answer for you, everybody has to answer that themselves. But for myself I would choose disability insurance as the most important if I had a manual labor job that my family relied on for their sole source of income.

If I die, that’s really bad but my wife can either start working herself to make up for lost income, or marry somebody else as crass as that may seem. The point is, they have options.

If on the other hand I lose my eyesight or break a vertebrae in my spine that keeps me from working anymore, then we don’t have that many options. My wife may not be able work because she might have to take care of me full-time and alternatively she wouldn’t be able to marry somebody else because I’d still be around, barring divorce of course. The scientists added a vitamin to their drinking water beginning at four months of age. The researchers then tested the animals’ short-term and long-term memory during the next four months.

They tested memory patterns known to be dependent on certain brain structures that are damaged by Alzheimer’s. The nutrient? It’s the simple $2 nutrient niacinamide. Niacinamide is just an easy-to-tolerate form of vitamin B3. And its ability to treat Alzheimer’s is truly amazing.

The results of this study showed that oral niacinamide treatment prevents the cognitive deficits in mice with Alzheimer’s, while improving the short-term spatial memory in non-demented control animals. At the end of the study the Alzheimer’s mice performed as well in memory testing as healthy mice.

This suggests that the vitamin protected their brains from memory loss and restored memory that was already lost. I don’t need to sell you on this. Just look at the words of author Dr. Kim Green. “Cognitively, they were cured,” Dr. Green said. “They performed as if they’d never developed the disease.” “The vitamin completely prevented cognitive decline associated with the disease, bringing them back to the level they’d be at if they didn’t have the pathology.”

Furthermore, healthy mice fed the B3 performed better than mice on a normal diet. “It actually improved behavior in non-demented animals, too,” said Dr. Green. Dr. Frank LaFerla, the lead author of the study, said: “This suggests that not only is it good for Alzheimer’s disease, but if normal people take it, some aspects of their memory might improve.”

How does niacinamide work? Neurons are constructed with microtubules. These are scaffolding within the cells that conduct information. When the microtubules break down, the cells can die.

JEAN EDWARD CARREY, Plaintiff and Respondent, v. DEPARTMENT OF MOTOR VEHICLES, Defendant and Appellant

On October 21, 1984 Carrey, the respondent was arrested for the felony offenses of drunk driving and hit and run. He was advised of the “implied consent” law, Vehicle Code section 13353 (now section 23157). The respondent had requested the blood test and was asked to sign the hospital’s “Consent to Blood Test” form. After reading this form, Carrey refused to sign that form because he was taking some medicines that could affect his bleeding. He was asked to take a breath test or urine test but he continued to insist on a blood test. Subsequently the DMV issued an order of suspension to Carrey. Later the respondent had filed a petition for administrative mandamus in the superior court to which the DMV responded. The superior court issued the writ of mandate forbidding the DMV from suspending Carrey’s driving privilege. This appeal by DMV followed.

Issues:

Whether respondent’s refusal to sign the medical consent form was the pragmatic equivalent of a refusal to consent to the procedure involved?

Whether the lower court had erred in issuing the writ of mandate forbidding the DMV from suspending the respondent’s driving privilege?

Discussion:

This court held that if the driver refuses to complete one of the three tests, his driving privilege is subject to suspension. There is a strong public policy against the nightmare of drunk driving. Thus, the implied consent law should be liberally construed to effect its purpose, which is to swiftly and accurately identify drunk drivers. Consequently, the driver should clearly and unambiguously manifest the consent required by the law. Consent which is not clear and unambiguous may be deemed a refusal. The determinative factor as to whether there is a refusal is not the arrestee’s subjective state of mind, but rather the objective, fair meaning to be distilled from his words and conduct. In the case at bench, The respondent reviewed the form entitled “Consent to Blood Test” and stated he would not sign it The crux of the form is an acknowledgement that the driver has been advised of his choice of tests and that he is not physically incapable of taking the test. The form represents a sensible precaution from the hospital’s standpoint and imposes no significant additional onus on the driver. This court held that Section 13353 (e) c.v.c. grants the driver an exemption from the blood test because he is using an anticoagulant, however does not make the driver ineligible if he wishes to take a blood test. Hence, Carrey’s refusal to sign the medical consent form was the pragmatic equivalent of a refusal to consent to the procedure involved.
